In response to the U.S. government's announcement on February 1st to impose an additional 10% tariff on all Chinese goods exported to the United States, citing issues such as fentanyl, which severely violates World Trade Organization rules, China has today introduced a series of countermeasures including tariff increases, investigations into Google, export controls, and the "Unreliable Entity List."

A spokesperson for the Chinese Ministry of Foreign Affairs has previously stated that China has repeatedly expressed its position, always believing that there are no winners in trade wars or tariff wars. China remains steadfast in safeguarding its national interests.

01 Imposing Tariffs on Some Imported Goods Originating from the United States
Today (4th), the Customs Tariff Commission of the State Council issued the "Announcement of the Customs Tariff Commission of the State Council on Imposing Tariffs on Some Imported Goods Originating from the United States":

Announcement No. 1 of 2025 by the Tariff Commission

On February 1, 2025, the U.S. government announced a 10% tariff on all Chinese goods exported to the U.S., citing issues such as fentanyl. The unilateral imposition of tariffs by the U.S. severely violates World Trade Organization rules, not only failing to address its own issues but also damaging normal economic and trade cooperation between China and the U.S.

In accordance with the "Customs Law of the People's Republic of China," the "Customs Law of the People's Republic of China," the "Foreign Trade Law of the People's Republic of China," and other laws and regulations, as well as the basic principles of international law, and with the approval of the State Council, tariffs will be imposed on some imported goods originating from the United States starting from February 10, 2025. The relevant matters are as follows:

  1. A 15% tariff will be imposed on coal and liquefied natural gas. The specific range of goods is detailed in Appendix 1.

  2. A 10% tariff will be imposed on crude oil, agricultural machinery, large-displacement vehicles, and pickup trucks. The specific range of goods is detailed in Appendix 2.

  3. For the imported goods listed in the appendices originating from the United States, the corresponding tariffs will be imposed on the basis of the current applicable tariff rates. The current bonded and duty-free policies remain unchanged, and the tariffs imposed this time will not be exempted.

In accordance with the "Export Control Law of the People's Republic of China," the "Foreign Trade Law of the People's Republic of China," the "Customs Law of the People's Republic of China," and the "Regulations on the Export Control of Dual-Use Items," and to safeguard national security and interests and fulfill international non-proliferation obligations, with the approval of the State Council, it has been decided to implement export controls on the following items:

  1. Tungsten-related items
    (1) 1C117.d. Tungsten-related materials:

  2. Ammonium paratungstate (Customs commodity code: 2841801000);

  3. Tungsten oxide (Customs commodity codes: 2825901200, 2825901910, 2825901920);

  4. Tungsten carbide not controlled under 1C226 (Customs commodity code: 2849902000).
    (2) 1C117.c. Solid tungsten with the following characteristics:

  5. Solid tungsten (excluding particles, powder) with any of the following characteristics:
    a. Tungsten and tungsten alloys with a tungsten content of 97% or more by weight, not controlled under 1C226 or 1C241 (Customs commodity codes: 8101940001, 8101991001, 8101999001);
    b. Tungsten-copper with a tungsten content of 80% or more by weight (Customs commodity codes: 8101940001, 8101991001, 8101999001);
    c. Tungsten-silver with a tungsten content of 80% or more by weight and a silver content of 2% or more (Customs commodity codes: 7106919001, 7106929001);

  6. Can be machined into any of the following products:
    a. Cylinders with a diameter of 120 mm or more and a length of 50 mm or more;
    b. Tubes with an inner diameter of 65 mm or more, a wall thickness of 25 mm or more, and a length of 50 mm or more;
    c. Blocks with dimensions of 120 mm × 120 mm × 50 mm or more.

    c. Ultimate tensile strength greater than 1270 MPa;
    d. Elongation exceeding 8%.

  7. Tellurium-related items

To safeguard national sovereignty, security, and development interests, in accordance with the "Foreign Trade Law of the People's Republic of China," the "National Security Law of the People's Republic of China," the "Anti-Foreign Sanctions Law of the People's Republic of China," and other relevant laws, and based on the provisions of the "Regulations on the Unreliable Entity List," the Unreliable Entity List Working Mechanism has decided to add U.S. PVH Group and Illumina, Inc. to the Unreliable Entity List.

The above-mentioned entities have violated normal market transaction principles, disrupted normal transactions with Chinese enterprises, and taken discriminatory measures against Chinese enterprises, seriously damaging the legitimate rights and interests of Chinese enterprises. The Unreliable Entity List Working Mechanism will take corresponding measures against the above-mentioned entities in accordance with relevant laws and regulations.

Matters not covered in this announcement shall be handled in accordance with the "Regulations on the Unreliable Entity List."

This announcement shall take effect upon its release.

04 Initiating an Investigation into Google
Due to suspected violations of the "Anti-Monopoly Law of the People's Republic of China" by Google, the State Administration for Market Regulation has initiated an investigation into Google.

05 Suing the U.S.
A spokesperson for the Ministry of Commerce stated on the 4th that on February 1st, the U.S. announced a 10% tariff on certain Chinese products. To defend its legitimate rights and interests, China has filed a complaint with the WTO Dispute Settlement Mechanism against the U.S. tariff measures.

The spokesperson said that the U.S. imposition of tariffs on Chinese products severely violates WTO rules, is egregious in nature, and is a typical example of unilateralism and trade protectionism. The U.S. actions seriously damage the rules-based multilateral trading system, undermine the foundation of economic and trade cooperation between China and the U.S., and disrupt the stability of global industrial and supply chains. The U.S. has repeatedly placed unilateralism above multilateralism, drawing strong condemnation from the majority of WTO members. China firmly opposes the U.S. actions and urges the U.S. to immediately correct its wrong practices.

The spokesperson stated that China is a staunch supporter and important contributor to the multilateral trading system. China is willing to work with other WTO members to jointly address the challenges posed by unilateralism and trade protectionism to the multilateral trading system and maintain the orderly and stable development of international trade.
